Questa è una fotografia il cui paese di origine è l'Italia e che è nel pubblico dominio in Italia poiché il suo copyright è scaduto. Secondo la legge 22 aprile 1941 n. 633 e successive modificazioni, «il diritto esclusivo sulle fotografie dura vent'anni dalla produzione della fotografia» (articolo 92) ovvero tali fotografie divengono di pubblico dominio a partire dall'inizio dell'anno solare seguente il termine dei vent'anni. In accordo al testo di legge, tali fotografie sono: «immagini di persone o di aspetti, elementi o fatti della vita naturale e sociale, ottenute col processo fotografico o con processo analogo, comprese le riproduzioni di opere dell'arte figurativa e i fotogrammi delle pellicole cinematografiche. Non sono comprese le fotografie di scritti, documenti, carte di affari, oggetti materiali, disegni tecnici e prodotti simili» (articolo 87).


Diventano invece di pubblico dominio al «termine del settantesimo anno dopo la morte dell'autore» (art. 32bis) le «opere dell'ingegno di carattere creativo» (art. 1), comprese «le opere fotografiche e quelle espresse con procedimento analogo a quello della fotografia sempre che non si tratti di semplice fotografia» di cui sopra (art. 2, c. 7).

  • It is an anonymous, pseudonymous or posthumous work and 50 years have passed since the date of its publication
  • It is a collective or audiovisual work and 50 years have passed since the date of its publication
  • It is a photographic work, and 25 years have passed since the date of its creation (or publication, whatever date is the latest)
  • It is another kind of work, and 50 years have passed since the year of death of the author (or last-surviving author)

  • Similarly, works published outside of these countries within 30 days of publication within these countries will also usually be subject to protection in the foreign country of publication. When works are subject to copyright outside of these countries, the term of such copyright protection may exceed the term of copyright inside them.
  • Unpublished works from these countries may be fully copyrighted.
  • A work from one of these countries may become copyrighted in the United States under the URAA if the work's home country enters a copyright treaty or agreement with the United States and the work is still under copyright in its home country.
Ethiopia has enacted a copyright law as published in the Official Gazette (unofficial English (WIPO) translation) which came into force on 19 July 2004.

This is because its author has died, and 50 years have passed since publication, by the virtue of Articles 1653 and 1670 of the Eritrean Civil code. In the case of anonymous works, the publisher becomes the copyright holder per Article 1667.

Eritrean photographs are only protected if they are part of a collection or book, or bear the name and address of the author or their agent. In all other cases, photographs are not protected by copyright (Article 1662).
